These Terms of Service ("Terms") govern your use of the CallOutcome platform operated by CallOutcome ("we", "us", "our"). By creating an account or using our service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using CallOutcome, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.
2. Description of Service
CallOutcome is an AI-powered call scoring platform that analyses call recordings and transcripts to classify whether a job was booked. The service includes call transcription, AI classification, dashboard analytics, partner logins, and data export features.
3. Account Registration and Security
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately if you suspect unauthorised access to your account.
4. Acceptable Use
You agree not to:
- Upload or process call recordings that were obtained without the consent of all parties, where such consent is required by applicable law.
- Use the service for any illegal purpose or in violation of any applicable laws.
- Attempt to interfere with, disrupt, or compromise the security of the service.
- Share your account credentials with unauthorised individuals.
- Reverse engineer, decompile, or attempt to extract the source code of the service.
You are solely responsible for ensuring that your use of call recordings complies with all applicable laws regarding call recording consent in your jurisdiction.
5. Billing and Payments
- Paid plans are billed monthly via Stripe.
- Your subscription renews automatically each month unless cancelled.
- You may upgrade, downgrade, or cancel your plan at any time from your billing settings.
- Refunds are handled on a case-by-case basis. Contact us at support@calloutcome.com if you believe you are entitled to a refund.
- All prices are in USD unless otherwise stated.
6. Service Availability
We provide CallOutcome on a best-efforts basis. We do not guarantee uninterrupted or error-free operation of the service. We may perform scheduled maintenance and will endeavour to provide reasonable notice where possible. We do not offer a formal Service Level Agreement (SLA).
7. AI Accuracy
CallOutcome uses AI to classify calls. While our AI is highly accurate, it is not infallible. You should review classifications and use the manual override feature where needed. We are not liable for decisions made based on AI classifications.
8. Intellectual Property
All rights, title, and interest in the CallOutcome platform, including its design, code, and branding, remain with us. You retain ownership of your call recordings and data. By using the service, you grant us a limited licence to process your data solely for the purpose of providing the service.
9. Data and Privacy
Your use of CallOutcome is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the service, you consent to the practices described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law:
- CallOutcome is provided "as is" without warranties of any kind, whether express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim.
11. Termination
- You may cancel your account at any time.
- We may suspend or terminate your account if you breach these Terms.
- Upon termination, your access to the service will cease. You may request deletion of your data by contacting us at support@calloutcome.com.
12. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the website. Your continued use of CallOutcome after changes are posted constitutes acceptance of the updated Terms.
